Why would they file this lawsuit again if it's already in progress?

The more suits the merrier. Maybe they will present an issue that was not presented in the previous case and lead the courts to accept this one instead. They shouldn't make it easy for Chris Christie to pull of his homophobic agenda .Hope this helps
